A new set of rules, regarding receiving equal pay for doing the equal work are now being implemented in Ontario. The requirement is that all the categories of employees – part-time, seasonal and casual, must get the payment at the same rate. This rate is comparable to the rate of full-time employees in case they do the same types of jobs.

Upcoming new rules

These rules will come into effect from April 1. They are a part Fair Workplaces, Better Jobs Act of the province. It is the similar law which had increased the minimum wages in Ontario (to $14 per hour) on the arrival of the New Year.
These rules are pioneering in nature. It is the first area in North America which will pay equally to the employees working in part-time basis.

Amendment

Presently, the rules have made an amendment to the Employment Standards Act of the province. It says that the state employers cannot make a less payment to a temporary or part-time worker. The rate in question was the one making the payment to full-time workers if they do the same kind of work. It also mentioned about the same skills and efforts needed, and discharging similar responsibility. There was also a clause regarding doing work in similar conditions.

Exemptions

The law permitted exemptions which are based on merit, seniority, or a measuring system to know earnings by quality/quantity of production.
The government in Ontario says that these rules will give protection to temporary workers. Presently, the part-time workers represent 20 percent of total workforce.

Employees get a right

In these rules, the employees get a right to request about reviewing their pay rate. This will be considered in case they are not receiving equal pay for their work compared to full-time employees. The employer must respond to this request. He must adjust the pay, or give an explanation in writing for the issue.
Furthermore, the New Act will give protection to workers if any impact happens for inquiring regarding this pay rate. They also get protection, when they ask other employees regarding their wage.
All Agencies must presently ensure that the temporary employees receive proper payments. This must be similar to wage paid to full-time workers when they are doing a similar task.

An observation

There is an observation in the province, in the past 20 years, that the Temporary Help Agencies have come up everywhere. They are creating troubles like the happening of permanent – cum temporary workers. Here, the workers get contracts consecutively, and they do not get jobs in Ontario for full-time. In fact, they get the payment at a low rate and also do not receive any benefits.

The path to the future

Navdeep Bains, the Innovation Minister, said that 5G is the path to the future. He was speaking about the variety of applications, to employ using the fresh technology. These include having smart cars, which reduce traffic congestion and accidents. It will permit the refrigerators, which effectively keep a track of food levels, and call for fresh groceries automatically. He continued to say that Canada is on the threshold of a great technological revolution.

The scope of the project

The project is named ENCQOR meaning Evolution of Networked Services by using a Corridor in Quebec and Ontario to do research and Innovation.

Furthermore, it permits 1,000 businesses to connect to a specific 5G platform, and gain access to the latest technology.

High speed

Equally important, Mobile 5G Wireless Technology is 100 times fast, compared to the present 4G system. This was a golden opportunity, for experimenting and helping the business sector, to reach the top of the global race for innovation.

As a matter of fact, the Federal Government, Quebec, and Ontario have pledged $67 million each, and five partners of the private-sector will give $200 million. They are the Ericsson, Thales Canada, Ciena Canada, CGI and IBM Canada. Similarly, this plan envisages, having more than 4,000 jobs, of which nearly 1,800 will specifically belong to the 5G domain.

A spokesman clarified that the jobs comprise prevalent positions with the five partners in the private-sector and will undergo a restructuring for this mission.

The future

Borje Ekholm, CEO Ericsson, said that Canada is moving ahead to the forefront of 5G technology and has a firm commitment to Wireless Innovation. Likewise, National infrastructure is not merely roads, but projects like the one planned here. The future highways would be digital, he added.  He expects that this test-bed technology would be formulated and used in future and be functional during the first quarter of 2019.

Equally, the government has estimated that the Information and Communications Technology Sector, made a contribution of $76 billion, to the GDP of the nation in 2017.

4% jobs in British Columbia have remained unfilled, and there are signs of an increased labor shortage in Canada. Data shown by the Canadian Federation of Independent Business reveals that there are not enough workers for all jobs in the country.

As per the CFIB Help Wanted Survey, 399,000  jobs vacancies existed at the end of the fourth quarter. There was an increase of 38,000 vacancies, in three months which corresponds to nearly 10.5 percent. In British Columbia, 3.9 percent of all jobs were vacant.  This shows an increase from 3.6 percent seen three months ago. Quebec had a vacancy rate of 3.4 percent showing an increase from 3.1 percent.

The labor shortage is visible at a time when there is a  strong job market in Canada. The unemployment rate is 5.8 percent in February, which is low in the nation since 1976. This reflects that the economy of the country is doing extremely well.

1.Skilled labor shortage

At present, there are more than 1.1 million unemployed people in Canada. It is structural in nature and some people are between jobs but it also reflects the fact that there is a continuous mismatch between the available workforce and the jobs which are presently being created in the country.

Presently, the data from Statistics Canada reveals that Canadians are not interested, like before, when they were a mobile labor force. There is a huge decline in the Interprovincial migration since 1970. The people attach priority to their families and social circles and are less interested to move for jobs.

The Expedited Policy pursued by Canada has created a process regarding the claims by petitioners who are nationals of certain countries. It is determined whether the person is a Convention refugee or a person requiring protection without a hearing. The expedited process is a method for resolving all the refugee claims in a fair and efficient manner.

Security issues remain supreme in this expedited processing and the claimants of refuge in Canada need to go through security screening. It is conducted by the CBSA jointly with the CSIS.

Additionally, a representative of the Minister has the right to intercede and initiate some evidence and also question the claimant regarding refugee claim. When the representative of the Minister indicates an intention to intervene, the claim loses eligibility to be considered for accelerated processing.

In case of receiving security screening confirmation at the RPD and a situation where the representative of the Minister decides not to intervene, it does not mean that all claims from the countries will have expedited processing. On reviewing the file, if the member decides that it is not proper to approve it based on the proofs available, the claim goes for a hearing.

Only a few claims from specified nations have the eligibility to be considered for the expedited process. In order to be successful for the claim, it needs to originate from a country which is designated under the Policy of Expedited Processing for Refugee Claims.

The designation of a Country is based on the fact whether claims from that country are proper to be considered without resorting to hearing. The following factors are also considered:

  1. The latest rate of acceptance of claims it;
  2. Claims do not generally involve complex issues; and
  3. The volume of cases heard by the RPD from that country.

Countries eligible for the expedited process from January 1, 2018

  • Afghanistan
  • Burundi
  • Egypt
  • Eritrea
  • Iraq
  • Syria
  • Turkey
  • Yemen

The expedited process only applies to claims made in Canada

The RPD decides refugee claims which are made in Canada only. Probable claimants in Canada need to talk to a CBSA officer at a legal port of entry on arrival, or to an IRCC officer or of CBSA. The officer takes a decision regarding eligibility. If found deserving, it is sent to the RPD to start the processing of a claim for refugee status.

Eighty human rights groups have signed an open letter, which applauds the move of the government, requiring all the groups, which seek funds through the Canada Summer Jobs program, to affix their signature, on an attestation, mentioning that they extend support to constitutional rights in Canada, and also the right to reproductive choice.

Effective result of coordination
  • The letter was the result of coordination of Action Canada for Sexual Health and Rights, as well as National Association of Women and the Law –NAWL. It praises the government for a move, which some advocates feel, that it targets anti-abortion and anti-gay groups, restricting their access to funds, and is used in supporting activities, which restrict access to abortion, and also discriminates against Lesbians, Gays, Bisexuals, Transgenders, and Queer Canadians.
  • The attestation demands, that all groups, which seek federal funding, in this program, must sign, mentioning that the organizational mandate, and duties of the job, to be funded by the grants, gives respect to the individual human rights in the country, and also the values fundamental to the Canadian Charter of Rights, and Freedoms, along with other rights.
Other rights
  • Among the other rights are reproductive rights, and the right not to be discriminated, on the parameters of sex or religion, race or national origin, ethnic origin, the color of the individual, mental disability, physical disability, sexual orientation, or gender identity or gender expression.
  • The change facilitated in this program, which is used by the government, to offer subsidy to summer employment of students in the age range between 15 and 30 years, who return to school in the fall, focuses on anti-gay and anti-abortion groups, which have been using the program, for activities like displaying and distributing, explicit posters of bloody foetuses.
No plans to restrict women rights
  • Patty Hajdu, Employment Minister, has mentioned that the Canadian Centre for Bio-Ethical Reform, a recipient of thousands of dollars in the program in the past, is one such group, which plans to restrict the right of women, in Canada, to seek an abortion and they must not be permitted to get federal funds.
  • Abortion is not listed as a right in the Charter of Rights and Freedoms, but the Supreme Court made a decision in 1988, that the law prevalent at that time which restricted abortions, was unconstitutional.
  • Some conservative religious groups accused the government that it had violated their right to freedom of belief, as well as freedom of conscience, by forcing them to sign the attestation, which essentially betrays their beliefs.
Federal Court intervention
  • An anti-abortion group filed a suit in the Federal Court, alleging the requirement of attestation was a violation of the Charter of Rights and Freedoms and made a plea to the court for reversing the change.
  • In an open letter sent to PM Trudeau, several prominent leaders and 80 human rights groups extended their support to opt for the attestation.
  • They were confident that the safeguards that were introduced into the CSJ program were non-discriminatory, and did not infringe on the freedom of religion, or conscience, and did not affect any rights enjoyed by the people in Canada. Many prominent groups also attached their signatures to the letter.
PM defends the decision
  • PM Trudeau defended the decision and has spoken against anti-abortion groups saying that they were not synchronized with the Canadian society. The government will not fund a group, which restricted women, from seeking an abortion.
