The Malaysian Bar is deeply concerned about the frequency and severity of water pollution incidents— a form of environmental damage — in the country. On 7 March 2019, news broke out about the industrial pollution in Sungai Kim Kim in Johore, which reportedly affected the health of almost 6,000 people. A week later, the Selangor Water Management Authority reported that pollution believed to have been caused by chemical waste had been detected in the Klang River. It is the Malaysian Bar’s view that contamination of water sources must be regarded as a threat to national security and well-being, and be dealt with as such, urgently and with the utmost seriousness. The importance of protecting our water sources — including rivers, seas, lakes, ground water, dams and reservoirs —was recognised by Parliament through the enactment of the Water Services Industry Act 2006, which gives the Federal Government the executive authority in respect of all matters relating to water supply systems and services. The legislation provides for severe penalties for offences, signifying the gravity of the issue of water safety.Article 5 of the Federal Constitution, which provides that “[n]o person shall be deprived of his life or personal liberty save in accordance with...

Contributed by Francis Ng Sai Wai, Convener for Badminton, Bar Council Sports Committee; and photos by G Shagela Nair, Officer, Bar Council Sports Committee, Bar CouncilThe 50th edition of the Bench and Bar Games between Malaysian Bar and the Law Society of Singapore was held in Singapore from 27 April to 29 April 2019.The Malaysian Bar Badminton Team as well as the teams for the other sports were instructed to begin their training much earlier than usual in anticipation of the strong challenge from Law Society of Singapore since this is the Golden Jubilee edition and Singapore being host is expected to mount a strong challenge to win the series. It was not the norm and slightly unusual for badminton to be played on a Friday night for the Bench and Bar Games but probably necessary for scheduling and logistical purposes. This year as was in 2017, badminton was played at The Singapore Swimming Club at Tanjong Rhu Road. The bus picked up the Malaysian Bar players at approximately 5:45 pm and made its way laboriously through the Friday evening traffic before reaching the venue at approximately 6:30 pm.

Article contributed by John Chan Chia Yoong and Lee Guan Tong, Co-Conveners for Volleyball, Bar Council Sports Committee; and photos by Florence Laway, Senior Administrative Assistant, Bar CouncilThe Malaysian Bar Volleyball Team for the Golden Jubilee Malaysia/Singapore Bench and Bar Games 2019 comprised nine players with vast winning experience in the Games. We welcomed three new faces in Cyrus Lim Kia Chun and Yap Yung Sheng, and Tan Ling Sing (the only pupil in chambers in the Team). Our training for the Games started almost immediately after welcoming the new year. Overall, we had 16 training sessions (including four extra weeknight sessions). Our coach in his second season with the Team continued with his training regime and vision to improve the Team’s playing standards. The Team was treated to intense and advanced level drills session after session. Missing some experienced players this year, the Team knew they had to buck up, train harder and sharpen their skills. This is especially after witnessing how well the Singapore Team performed in the Annual Tripartite Volleyball Games between the Malaysian Bar, Law Society of Singapore and Law Society of Hong Kong in November 2018.On the game day,...

The Malaysian Bar notes that Latheefa Beebi Koya (“Latheefa Koya”) has been appointed as Chief Commissioner of the Malaysian Anti-Corruption Commission (“MACC”) with effect from 1 June 2019. The Malaysian Bar acknowledges that since coming into power, the Pakatan Harapan Government has recognised and appointed Members of the Malaysian Bar to head key government institutions — Dewan Rakyat, Attorney General Chambers, Election Commission, Asian International Arbitration Centre, and Securities Commission, among others. While Latheefa Koya has been a vocal advocate in standing up against injustice, and has been actively involved in numerous public interest and human rights cases, the Malaysian Bar is concerned with the manner in which the appointment took place, as well as her suitability to hold this high-profile and weighty position. We note that the Parliamentary Special Select Committee on Major Public Appointments (“Parliamentary Special Select Committee”) set up by the Pakatan Harapan Government in December 2018 was not involved in the process of Latheefa Koya’s appointment. However, the Pakatan Harapan manifesto had recognised that “key national positions such as appointments to the … Malaysian Anti-Corruption Commission … must be approved by a suitable parliamentary committee. This will reduce the ability of the Prime Minister to...

©The Star (Used by permission)by Susan JosephFound the property of your dreams? What can you do to ensure that the property particulars are what you are told they are?In Malaysia, under the Torrens system, the person named as proprietor on the title of the property is deemed the legal owner. It is advisable that you conduct a title search at the land registry or land office to verify the particulars of the title of the property before you pay any money or commit to a purchase.A lawyer can assist you to do so or you can conduct the search yourself. When you are satisfied that there is no impediment to the vendor transferring ownership of the property to you, you can then pay and proceed to secure the purchase.A word of caution, though. Before you do that, you should inspect the crucial terms of the offer to purchase, which you will be asked to sign when paying an earnest deposit. If you are uncertain what they mean, you should consult a lawyer before signing or making payment.Official search or private search?
