The case revolves around our client, a care worker, who allegedly suffered a back injury when helping a resident into her bed. She didn’t believe the bed was appropriate for the resident, which subsequently caused her the injury.

Under the HM Courts and Tribunals Service’s (HMCTS) plan, more than half of the courts across England and Wales were closed in the years between 2010 and 2019.
The plan’s objective is to fund improvements to the court system, such as new digital services, by selling underused court buildings. On 4th January 2020, the claimant was walking along the pavement in a busy shopping area when she tripped on a raised metal grid which was surrounding the base of a tree.
She sustained a fracture of the right radial head, and injuries to her face and mouth, and was left with permanent symptoms.
Liability was denied by Suffolk County Council and proceedings were issued against them.

Background
Prior to the Rule change the position was that if a Part 36 Offer was made by the other side and had not been accepted, and at Trial the Claimant failed to beat that offer then, although the Claimant had ‘won’ the Defendant was entitled to ask the Court to deduct from the Claimant’s damages the amount of costs they had incurred since the offer had been made.
This could be many thousands of pounds and in some cases could wipe out the damages award. This is called Qualified One-Way Costs Shifting or ‘QOCS’.

Express Solicitors represented the family of an injured child, which had unfortunately suffered catastrophic brain damage with life-long consequences.
The parents of the injured child approached us 18 months after the incident had occurred. In addition to their distress, they were also experiencing great financial hardship due to high care costs for their brain damaged child.
