TLDR: family member died in NY. Is there a way to easily found out the lawyer handling their will? Family member recently passed away. Years ago they asked me to be their executor and I agreed. A friend of this family member got involved with managing their affairs, possibly including power of attorney. I don't trust this person and want to make sure that my family member's wishes and will are followed, but I don't know who her lawyer was. My question is, is there some way for me to find out this information? For example, is the decedent's lawyer required to notify the state of new york "I am ..read more

Family drama or just leave it alone?

My stepmother (Wife #3) informed me my father recently changed his will. The estate is now being split 5 ways instead of 4 and my stepmother has now been made co-executor with me. When she first told me about the new split, I was pissed but I didn't share that with her. She says she wanted me to know because she's afraid everyone in the family will be mad at her and insists it was completely my father's decision with no input from her. She wants me to discuss with him. However, I'm not allowed to tell him how I found out about the change. At this point, I've calmed down, not interested in the ..read more

How to pick effective charities

Part of our estate planning is a chunk on charitable donation. I am looking for advice on picking effective smaller charities Obviously, we will be staying with registered charities [501(3)(c) in US]. How can we check to see that the majority of their contributions go where they are supposed to? How can we find out more about their reputation and community relationships other than relying on the charities own public relations? submitted by /u/MeFolly [visit reddit] [comments ..read more

I am pregnant with my first child and am increaslingly concerned about all the things that could go wrong, medically, in the next few months. I have about $900k-$1mm in assets but no real estate. My net worth is entirely in 401k, IRA, brokerage, HSA, CDs, and bank accounts. I have no debt, loans, or credit cards that I carry a balance on. My car is paid off and worth around $25k. I have no life insurance / POD benefits. I have no siblings. My partner and I are not married but have been together for 10 years. Both my parents are still alive. If I were to die with no estate plan in place, my un ..read more

It appears that upon our death the assets of out trust are to be distributed. Generally speaking does it make more sense to leave assets in the trust so as to protect beneficiaries from creditors? Wisconsin submitted by /u/macad00 [visit reddit] [comments ..read more

Hi everyone, question for solo EP attorneys regarding drafting programs. I am currently considering wealthcounsel, interactive legal, and lexis Nexis. Can you recommend a program you use to draft your clients estate planning documents? Also as a new attorney EP attorney can you let me know if either of these programs or the one you use has educational resources such as videos to help guide a new attorney in estate planning? Any recommendations would be appreciated, thank you! submitted by /u/Ordinary-Kiwi9695 [visit reddit] [comments ..read more

Living Trust

We went to a small local attorney for a consultation on a Living Trust. All went well and than he e-mailed me a document to sign to get started. It had a total of 13 bullet points. Most of them were fine, just explaining what he was going o do. The last three points I wasn't expecting though. "The attorney-client privilege does not permit lawyers to respond to online reviews, no matter how untruthful they are. Consequently, you agree not to publish an online review of our work or us without our express written consent." What? The last two dealt with the "resolution of fee disputes" and the "r ..read more

California: Steps After a Death with a Trust

My fiance's grandmother died in December. She had a trust set up in the 1990s, with some assets including stocks, bank accounts, and a house worth approximately $750,000 as of today. It's currently on the market for sale now. The beneficiaries of the trust are her two adult children and one adult grandchild. The two children are co-executors but really one child is doing the legwork and the other just signs when he is told. It works for them, whatever. The issue is that the one doing the legwork will NOT listen to us that there are steps that need to occur when the trustor died. We have told ..read more
