Located in Ohio and Philadelphia. My fiance has joint legal and physical custody of his 3 children with his ex wife. Kids are 15, 11, and 9. Fiance and ex physically separated in 2019, and got a court order for visitation and support in late 2020, and custody exchanges started shortly thereafter. Custody was one weekend a month, usually a holiday one so it's long, all of spring break, one week for Thanksgiving and one week of Christmas break. I’ll try to keep this short. Divorce agreement written from South Carolina. Plis resided in South Carolina, and defendant resided in Florida at the time of the final divorce agreement. Agreement states “ The parties shall have so ownership of the property in their possession, free from any claim by the other party” On the financial affidavit/property, affidavit, it list the the vehicle of interest here as an asset held by the husband, but coed by wife and husband. Is it normal to feel coerced into settlement with a judge saying at pretrial that he’s made up his mind and won’t be changing it? I was given the opportunity to decide between pushing to trial or settlement and my attorney asked for an extension for me to respond. The judge supposedly told him that I shouldn’t need time since he already made it clear he’s not changing his mind. I finally left my emotionally,verbally, financially abusive spouse after nearly 6 years. We had been talking about me adopting our oldest daughter (technically my step daughter) for years. My co-parent told me a few days ago he (and his wife, 3yo, dog and cat) are being forced out of the house they rent and don’t have anywhere permanent to move into. He tells me when my kids go to visit him (every other weekend, he is a 3 hour drive away in VA) he will “stay in an RV at his father-in-laws, or get a hotel somewhere”. Parenting plan required mental health evaluation within 60 days or my visitation would become supervised. Opposing counsel didn't like the evaluation and motioned for clarification. My previous evaluation met all criteria except consideration of a collateral statement provided by my ex.
