Associate Attorney Wendy Diaz talks about traveling and the law. Today I want to talk about traveling. With the airport’s opening up, traveling being more accessible, the pandemic restrictions lifting, and, of course, fall and football are starting, everyone is ready to get all of their anxious travel bugs out the way. And a lot of the time, people are accustomed to the customs of the police and the interactions of your community, and what is and isn’t permissible. And sometimes we forget that what’s allowed where we are normally, isn’t necessarily allowed in the places that we go. I get a lo ..read more

Associate Attorney Wendy Diaz takes a look at the timeline for the warrant that was executed by the F.B.I. at Mar-A-Lago. This is something of a first of its kind. No president has ever been served a warrant upon his home, including President Nixon. Before we get into the specifics as to what happened on August 8, let’s talk about the players of the game, so that way, you understand more about what’s going on. The warrant is basically a court order that allows a law enforcement agency to enter upon a person’s home and search for certain evidence of a potential crime, or of a potential civil i ..read more

4th Amendment and Search Warrants

A search warrant was executed at Mar-a-Lago, the Florida home of former President Donald Trump. The news was first released by Mr. Trump himself. Well, let’s talk about that. A search warrant was issued by a judge. We have a lot to unpack. And I find it ironic that this all happened on August 8, which we history buffs, fans of the presidency, will remember is the anniversary of Richard Nixon’s resignation speech. I can hear it now, that inimitable voice saying, “Effective noon tomorrow I shall resign the presidency of the United States.” Those were the days. Let’s talk about what happened wit ..read more

Attorney Michael Kessler in conversation with former NYC Detective Jerry Lyons about his work on the Casey Anthony case, and what most of us don’t know about that case. MK: Jerry Lyons is a licensed private detective, and a retired New York City police detective. And Jerry and I have worked on a lot of cases together. But today we’re going to talk about a case that he worked on that I didn’t. Jerry was the lead defense investigator for the Casey Anthony defense. Jerry, tell us about the Casey Anthony case. JL: Well, the last time we spoke, we talked a little bit about how the state – the cop ..read more

Well, of course, everybody is talking about Politico publishing the leaked draft of the United States Supreme Court abortion ruling that’s going to overturn Roe vs. Wade. Well, as a man, I don’t have the right to make decisions about women’s health issues. So I’m going to talk about the court and how they go about doing their job. And if I have time, I’m going to tell you who’s to blame for this. First of all, the Supreme Court has not always had nine members. There used to be fewer. Someday, maybe there will be more. We’ll come back to that in a little bit. But when the Supreme Court takes a ..read more

Associate Attorney Wendy Diaz weighs in on the leaked Supreme Court draft opinion on overturning Roe v Wade. The main focus of the draft opinion by Justice Alito is the abortion issue and Roe vs. Wade. It really takes a very personal and professional evaluation because I am a female, I am a lawyer, so I’m a female attorney. And this will affect not only the way that I live my life, but how I practice and how, not only myself but other male and non-binary attorneys will speak with their clients. Caveat: it’s a ninety-eight page draft, and I’m only about, maybe, 14-15 pages in. I just wanted t ..read more

Today, I’m chatting with my good friend, attorney Cliff Barnes about winning another one of those DUI cases that was thought to be unwinnable. CB: Well, I had a success in a case and I wanted to share it with the whole legal world. MK: Oh, that’s great. Is this another one of those cases that couldn’t be one? CB: Yeah, this is an unwinnable case, and we didn’t go to trial, so we didn’t completely win it, but we had a partial surrender by the state. MK: Well, that’s great. Tell us about it. CB: Well, this is a young lady, I believe she was 19 at the time. She’s driving dad’s car home from Arch ..read more
