Last week, USCIS published the quarterly statistics for Q1 FY2024 (October 1st – December 31st, 2023). The latest data release shed some light on the trends of the EB-5 Program in the new fiscal year, including demand for EB-5, USCIS processing trends, approval rates, and case backlogs.
In Q1 FY2024, the quarterly volume of I-526 case filings, including Form I-526 (direct EB-5) and Form I-526E, decreased by 35% from the previous quarter. USCIS data showed that 581 Form I-526E petitions were filed in Q1 FY2024 and 32 Form I-526 (direct EB-5) petitions were received by USCIS between October 1st ..read more

Earlier this week, the U.S. Department of State released the monthly Visa Bulletin for May 2024 (see here), showing no change for EB-5 cut-off dates in the upcoming month.
In the “unreserved” EB-5 category, the final action date for China remains to be December 15, 2015 in the upcoming month; while this date will continue to be December 1, 2020 for Indian nationals. The EB-5 dates for filing in May will remain the same as those from the February Visa Bulletin, maintaining at January 1, 2017, for Chinese applicants and April 1, 2022, for Indian nationals.

Under the Reform and Integrity Act of 202 (RIA), U.S. Citizenship and Immigration Services is now required to audit EB-5 Regional Centers at least once every five years. The audits will include the review of key information and documentation which each Regional Center is required to maintain.
Beginning April 23, 2024 USCIS will use Generally Accepted Government Auditing Standards when auditing Regional Centers.
