What is a drug test?
A drug test in employment background screening is the process of collecting a job applicant’s or an existing employee’s urine sample at a dedicated facility for the purpose of detecting the presence of specific substances. While this test can determine whether a person has a drug metabolite in their system, it cannot measure the frequency of substance abuse or how recently a substance was ingested. Every drug has its unique presence in the human body, rate of metabolization, and detection periods.
The most tested drugs are cocaine, opiates, amphetamines, cannabinoids, and ..read more

The California Consumer Privacy Act, or CCPA,
is an unprecedented privacy law that went into effect January 1, 2020. CCPA is
expected to be the strictest data privacy law in the U.S. and will accomplish
three major objectives, giving California residents the right to:
Know what information
businesses are collecting about them
Tell a business not to
share or sell their personal information
Protections against
businesses that do not uphold the value of their privacy.
CCPA compliance is a fast-approaching reality for organizations across the USA and the world. If they receive personal data fro ..read more

Earlier this month the CFPB released
a report on the background screening industry. The report details how
background reports including criminal records are generated, how those reports
are used by employers and issues those reports can have with accuracy. The
report also explains the potential hire’s rights when consumer reports are used
for employment including the requirement for prior notice, written consent and
a pre-adverse action report.
Employers need to take note of the requirements laid forth
by the FCRA that this
report highlights. The CFPB, private attorneys and other agencies ..read more

We’ve seen many large businesses paying
huge FCRA settlements but
small businesses can be caught in costly background check compliance traps as
well. When screening employees the FCRA requires specific notifications, and
disclosures along with authorization to begin a check. Finally, employers must follow
adverse action procedures if they may not hire a candidate. While the federal
rules are unchanging across the US, many cities, counties and states have
additional requirements for compliance that must be followed to avoid fines and
regulatory action.
