As the seller, there will be several documents that you will need to notarize as part of the online closing. To accomplish this, we utilize a company called notarize.com. How it works is that you will get an email from Notarize.com, which includes a link that you can use to review the documents. When you are ready to complete your side of the transaction, you will click on the link in the email, verify your identity and e-sign the documents. If you would like more information on the process, you can view the video below. You do not need to worry about signing your documents early as we w ..read more

I had the chance to speak with Kim Tucker from the Mid-American Association of Real Estate Investors (MAREI) about some basic legal concepts, such as forming LLCs and using contract forms you find on the internet. We also took a quick detour to discuss the Texas federal court decision that just came out finding that the CDC’s eviction ban was unconstitutional and why that isn’t as good of news as it sounds for Kansas and Missouri landlords. You can view the video below. After watching the video, please take a few minutes to check on the MAREI website and learn more about getting involved with ..read more

So I found this federal case
Rick Davis Legal | Real Estate Law Blog

I get this question quite a bit. One of my investor clients reaches out and says they found a case from a federal court that says they can (or cannot) do something and they assume it applies to them. Although this may be true, many times its not. Our federal court system is made up of 94 district courts and 13 Appellate Circuits. Decisions are only binding on lower courts, so a decision in a California federal court may not mean the courts would interpet the law (even federal law) the same way in Kansas or Missouri. Below is a short video that provides and overview of our federal court system ..read more

Commission Distribution

The vast majority of real estate agents work on commission, meaning that they are paid once the transaction closes. To simplify how commissions are routed, sales commissions are paid out of the seller’s proceeds, according to the terms of the listing agreement and/or the sales contract. Thus, the buyers’ agent commission is paid by the sellers, as a portion of their listing commission. All commissions paid to a real estate agent have to pass through their broker; only a broker can pay a commission and only a broker can sign a listing agreement or a buyer representation agreement. When the home ..read more

Once your home is listed in the multiple listing service (MLS), your agent will begin marketing your home to ensure it gets in front of as many potential homebuyers as possible. Since over 95% of consumers search online to find their next home, according to the National Association of Realtors Profile of Home Buyers and Sellers, your agent will likely ‘syndicate’ your listing to all of the major real estate websites. Syndication is the process of publishing your listing to multiple sites at the same time. Using the property details, the written description, and all of the digital media they’ve ..read more
