I’m calling a lawyer about bankruptcy. What should I be asking?

I applied to a modest means program and a lawyer about 2 hours from me wants to have an initial consultation. I’m about 38k in debt (medical, unsecured, secured) and about 9k in student loans. I’m hoping to file chapter 7 and reaffirm my car loan. What should I ask the lawyer? Anything about billing, common pitfalls, things to clarify before entering into a contract with him? submitted by /u/No-Structure523 [visit reddit] [comments ..read more

Paying Creditors Before Filing for Bankruptcy

Hi all, I have roughly a bunch of loans only 1 month or so ago I took out due to a gambling addiction. Predictably and horrifically, I lost it all. My BK attorney wants to wait 1.5 months before filing forCh 13 BK. This makes sense I guess, because it is a bad look taking out so many loans just to file for BK so shortly after. However, in this interim period before filing for BK, all of these creditors are going to be asking for my monthly payment. My attorney advised me to make these monthly payments so that it shows 'good faith' when I file for BK that I did intend to pay them back. However ..read more

Case closing

How long does it usually take for your case to be closed after discharge? I’m currently at 72 days at the awaiting closing. I know it probably doesn’t matter but I’m wanting to wait until everything is cleared up before applying for credit building cards and starting a side hustle (obviously nothing like what got me into this mess, just something extra to try to save) but I want a clean break and to not have to worry about checking the mail with some surprise from lawyers or the courts. I am just anxious in general and I want to know if it usually takes like 90 days or something from discharg ..read more

Hi all. Sitting here waiting for discharge. Got a bunch of mail saying "need a new car? Call us!" My car has a lot of problems and am just going to be giving it back to the lender post bankruptcy. Can these dealerships be trusted? I have not got my discharge yet. And they approved me for 18k... should I be worried? submitted by /u/Mundane_History_6261 [visit reddit] [comments ..read more

Post Chapter 7 Help

Maybe a simple question that can be answered, maybe not. I filed back in February (Chapter 7) and had my 341 on March 25th. 341 went well, the trustee said she’s going to file a no asset report and wished me well. I haven’t got my discharge letter yet, I’m a mechanic by trade and have run out of storage in my box and need to buy a bigger one. My question is, the tool truck guys typically will not take weekly payments on larger purchases, this will have to be done through credit. Will this affect my discharge? submitted by /u/coalcan118 [visit reddit] [comments ..read more

We are in the process of filing chapter 13 soon. Still have to pay the lawyer but we’ve met with them. I’m graduating nursing school in a few weeks so I am bummed about not being able to enjoy my new salary for 5 years. But school is part of the reason I’m in this mess. We are keeping our cars and home payment on our own. But since I have the more stable income (my husband is seasonal) the deduction will be coming out of my pay. I do own another home with 2 other family members that has a free and clear title. This is my biggest worry. They already assured me it’ll be protected by doing chapt ..read more

Hello all, I just need to get this off my chest cause it's causing me a lot of stress. I'm currently going through the process of Chapter 7 Bankruptcy, I finished paying the lawyers at the tail end of November and they have yet to file yet. The speed at which this office is working has caused much concern and because of said speed ive already had one judgement get passed against me. Come May 21st I have a deadline for another judgement against me for my lawyers to file the bankruptcy to keep it from passing. Now I am concerned about this one because it has an "unjust Enrichment" judgement tie ..read more

How does this work?

I have roughly $65-$70k in debt between CC’s and my vehicle.. If I were to file bankruptcy, would I be able to keep my vehicle? Or would I lose that for including it in bankruptcy? I haven’t been able to find an answer regarding this, even after talking with a bankruptcy lawyer. Bit confused on how this works. I need to be able to keep my vehicle 100%. On limited income at the moment. CC’s got racked up thanks to an ex that I’m finally divorced from. Thanks for any info. submitted by /u/NoseyReader24 [visit reddit] [comments ..read more
