In October 2015, a certificate of lawful use or development was issued under section 191 Town and Country Planning Act 1990 on the basis that the use of the land had become immune from enforcement. The day after the grant of the certificate of lawful use, the claimants’ solicitors served a notice on D1 purporting to terminate his agreement. If the person fails to leave the land, or, having left, re-enters it, they can be arrested and their vehicle (which could include a caravan used as a home) can be impounded. It is a defence to show ‘reasonable excuse’ for failing to comply with the direction to leave the land. The new offence applies to both England and Wales. The new offence has greatly increased the already existing powers of eviction. The Respondents were ten Local Authorities who have or have had wide Injunctions covering many areas of land and banning Gypsies and Travellers from stopping on those areas of land. There were interventions by: Friends of the Earth; Liberty; HS2 and the Secretary of State for Transport. Mr Mitchell rented a piece of land from Rosemary Dean in 2000 so that he could live there in his coach. After Rosemary Dean died, the land was inherited by her daughters who continued the rental agreement with Mr Mitchell. In 2015 they applied for and obtained a Certificate of Lawful Use which amounts to the same thing as planning permission for the use of the land as a site for a caravan.
