[IL] Judge Bias

My attorney has opined that my judge is being completely unreasonable and agreed that there is an obvious bias that necessitates her recusing herself. However, there is no hard evidence of the bias, as discussions happened in chambers without a court reporter. How can I find evidence about this? The judge is making her decision in opposition to the state statute of what is in the child’s best interest. My teen is hysterical and insistent she does not want to be with the other parent and has reported multiple instances of emotional and psychological abuse with name calling, gaslighting and int ..read more

I have temporary guardianship of my sister’s child, while working in court towards permanent guardianship. My sister has not exercised visitation with her child in over two months. In court, she has voiced her opinion about the child going several places with my family, saying she doesn’t feel it’s safe. The judge has sided with her and has said we cannot go to these places with her son. Is this something we could change or argue against? submitted by /u/xxMANEATERxx [visit reddit] [comments ..read more

South Dakota- Child Support

My husband and I need to get divorced. It is very contentious. We have three kids. He receives social security and the kids get social security money from this as well. My income is equal to his SSD plus the kids. Will I have to pay him child support if he gets 50/50 custody? What if he got 25%? I don’t know how I would be able to pay him child support and survive. I just need to get away from him. submitted by /u/Sad_Sugar_4033 [visit reddit] [comments ..read more

My form was rejected for the simple reason that my friend forgot to put the date and time served. Can she just file a new form with the correct date and time, or is there an amendment process that I have to go through/request? She served back in August of 2022 for background info.. does this matter that she would be re-filing it so far after the fact? THANK YOU! submitted by /u/blackdogblindcat [visit reddit] [comments ..read more

Washington state divorce and “off schedule” child support

I am waiting for my final divorce paperwork to go before a judge in the next few weeks. We are doing child support “off schedule” because we are still living together as a family unit and co-parenting. I am wondering how likely it is that this will delay the divorce being finalized? My paralegal who helped us file everything doesn’t think it’ll be an issue but obviously can’t make any guarantees. We used a paralegal, as a lawyer was too expensive. Has anyone else here done “off schedule” child support with their divorce and had issues getting the judge to finalize? I need it wrapped up by the ..read more

Hi, My ex-wife and I have legal joint custody of our children in California. About three months ago, and issue came up with my oldest son (8 years old) that resulted in him staying with me for 5 weeks. In order for him to feel safe returning to his mother's home, he wanted to speak with a therapist. He has done that and has been back to 50/50 custody for a few months. He has continued to see this counselor monthly along with my ex-wife. The therapist he uses was given consent to treat him by both of us. Over the past couple months after talking with my son, I've changed my mind and no longer ..read more

My ex and I used to split custody 50/50, and because his income was higher, and since he didn’t have to pay for housing (his father bought a house for him), he paid me $400/mo in CS. We did not go thru the court. My ex had been collecting a paycheck through his father’s business for the past twenty years, however, when his father passed six months ago, the paychecks stopped, so now my ex is living on inheritance received. My ex has also given up all custody of our two kids, so they have been staying with me 100% of the time. So to summarize, my ex….. •is currently unemployed, and not looking ..read more

(FL) changing income and child support

My ex has been untruthful about his income over the years and I'm wondering what, if anything, the court will hold him responsible for. He initially lied about being unemployed and then later refused to share paystubs when I suspected his income had increased. Child support has changed based on my income changes but has always been calculated on his very low imputed income. None of these changes happened via court order. Now that we are back in court for custody issues CS will be revisited. Will the court look at his refusal to acknowledge income changes or will it just move forward based on ..read more
