Legislation that supports a collaborative approach to to regulating cybersecurity in the water sector was introduced in the U.S. House of Representatives in April. Spearheaded by Reps. Rick Crawford (R-Ariz.) and John Duarte (R-Calif.), H.R. 7922 authorizes an independent, non-federal entity to lead the development of cybersecurity requirements in the sector. Bipartisan legislation was introduced in the U.S. House of Representatives that would provide a statutory shield for water systems under the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA) for PFAS, and help ensure that polluters, not the public, pay for PFAS cleanup. The bill, H.R. 7944 – the Water Systems PFAS Liability Protection Act – was introduced by Reps. The U.S. Environmental Protection Agency and the Commonwealth of Kentucky are working with the City of Lexington, Kentucky to extend the compliance deadline of an existing consent decree to resolve issues related to the city’s sanitary sewer systems. The amended consent decree, which will be lodged with the Court and subject to a public comment period before it is entered by the Court, will extend the current compliance deadline for the city to complete sewer system improvements from December 2026 to December 2030. On Wednesday, the U.S. Environmental Protection Agency (EPA) announced a final National Primary Drinking Water Regulation (NPDWR), establishing Maximum Contaminant Levels (MCLs) for six per- and polyfluoroalkyl substances (PFAS). The long-awaited regulation has drawn pushback from the water sector over the cost increases it may impose on utilities and ratepayers. The final rule will regulate PFOA and PFOS to MCLs of 4 parts per trillion (ppt). The U.S. Environmental Protection Agency (EPA) has announced a $10 million Water Infrastructure Finance and Innovation Act (WIFIA) loan to the City of Memphis, Tennessee.
