How do juries really get chosen? In this episode, our dynamic duo takes on the world of jury exclusion, discussing how and why some jurors are taken out of a jury pool and excused for cause and how others are removed for no good reason at all. In particular, we take a look at the little known use of Batson Challenges during jury questioning, through which an attorney can challenge the exclusion of a jury member. These challenges go to the heart of the Equal Protection Clause of the 14th Amendment, because they claim that a jury member is being excluded only on the basis of discrimination.
