Recently our firm received an email from https://here4thekids.com/ It begins: Our Objective:  This is really simple. We are demanding that Colorado Governor Jared Polis sign an Executive Order banning all guns and implementing a buyback program across the state of Colorado. That’s it. Reading on, I was pleased to see that the group at least recognized their “Objective” is patently unconstitutional:  Yes, of course this conflicts with the Second Amendment. We realize this. Here’s the deal though: The Second Amendment was enacted to uphold white supremacy. And as a r ..read more

TFA and GOA Protect Rights Against Govt Warrantless Searches

I am pleased to have co-authored an amicus brief on behalf of the Tennessee Firearms Association and Gun Owners of America opposing the unlawful and outrageous behavior of the Tennessee Wildlife Resources Agency. Read the TFA announcement and amicus brief here. In this case, TWRA agents entered private property, without a warrant or consent, to search for evidence of hunting violations. The TWRA even went so far as to place surveillance cameras (trail cameras) to spy on the property owners on their own property! Unfortunately, the Tennessee Attorney General’s office take the position that is a ..read more

Yours truly was recently interviewed by WDEF.com in Chattanooga about ongoing legal challenges to the ATF’s final rule 2021R-08F, “Factoring Criteria for Firearms with Attached ‘Stabilizing Braces.’” Reed Martz, an attorney who specializes in Second Amendment law, says, “There’s a lot of similarities between the lawsuits. They’re all seeking to overturn the final rule because of a variety of different reasons. Including that the rule was not properly implemented, that it is impermissibly vague. That it exceeds the ATF’s authority. That it violates the Second Amendment of the United States Con ..read more

Interesting traffic stop

As described by The Chattanoogan.com. Kudos to whoever wrote this summary and used the acronym “PMF” (privately manufactured firearm) instead of calling it a “ghost gun“. I would caution the driver about pocket carrying a G43 without a holster. I cannot think of a lot of places I want a 9mm hole, but I certainly can think of plenty of places near my pants pocket that I do NOT want a 9mm hole. An officer initiated a traffic stop at 7200 Lee Hwy. and the car had three occupants. The driver told the officer he had two firearms on his person, and another one in the glove box. The officer also saw ..read more

Total permits issued/re-issued: 67,385 permits. 7,402 Enhanced Carry Permits, 5,989 Concealed Carry Permits, 9,374 Lifetime Permits, 28,930 renewals, and 15,373 duplicates and free permits. 10.9% were original enhanced permits, 8.9% were original concealed carry, 42.9% were renewals, 22.8% were duplicates, 0.5% were free, and 14% were lifetime. 35% decrease in the number of permits issued from 2021. This is, perhaps, the result of Tennessee’s permitless carry law which went into effect in 2021. Permits were issued within an average of three (3) days from application. • Total Handgun Unit R ..read more

Police Blotter: Loaded Gun Stolen From Unlocked Vehicle; Someone Leaves Gun At Chattanooga Billiard Club A man on Northshore Drive told police someone entered his wife’s 2022 Bronco and stole a black SCCY 9mm pistol from the glove box. He said one magazine was inserted with 8-9 rounds loaded. He is unsure what time the theft occurred, saying it was sometime between 8 p.m. and 11 a.m. He said the vehicle was unlocked during this incident and no damage was discovered on the vehicle. No suspect information is available. Police entered this firearm into NCIC as stolen. An employee at Chattanoog ..read more

PSA: Record your serial numbers

Earlier this week I was contacted by a gun owner about a matter involving missing firearms. The owner had not been irresponsible, but the guns were missing all the same. One of the major problems that came up in discussing how to proceed is that the owner did not have a list of the serial numbers for the firearms. Part of responsible gun ownership is taking reasonable precautions against loss or theft. Another part of responsible ownership is being able to track firearms that are lost. There are lots of reasons for this including: A serial number is much more useful to law enforcement than a ..read more

FBI Secretly Pressured Americans To Waive Away Their Gun Rights

Learn more about this developing story here. Reed Martz, a lawyer who runs a Second Amendment blog, told the DCNF “there is implicit pressure any time the FBI is asking you to sign a form.” There is naturally “an adversarial relationship” between everyday people and the FBI, he said. “The FBI presented this to people,” said Martz. “That is terrifying to me. Think about that. The whole thing is chilling.” If the signatory does not have the “mental capacity” to own, buy or use firearms, they “could not possibly have the competence” to agree to sign a form waiving away their gun rights, said M ..read more

According the Tennessee Conservative (citing numbers from 24/7 Wall St.), gun sales are down from their historic highs, but people are still buying a lot of firearms. Below are the rankings and rates in the four states served by this website. Also included in first place (per capita) is Kentucky. The #1 state by total volume is Illinois at 6,707,482.00. Keep in mind these numbers are based on background checks. Background checks are useful but not definitive because some checks involve more than one firearm, some checks are declined or the sale canceled, and the checks do not capture private ..read more
