I'm living in Texas. I'm paying off a used 2006 pickup truck I acquired from a dealership 6 months ago which was financed through a financial lender. I was cutoff on the road and I spun out and hit a pole. Other driver took off. No police report. I filed a claim with my insurance company with me being at fault. CA driver receiving a VC 21655.5 (b), failure to obey posted sign for preferential traffic lanes. On the ticket, it is listed as an infraction and I have a notice to appear. Yesterday morning I was taking my son to school when somebody ran a stop sign and my car was totaled in the accident. The other car seemed ok, just damage to the front passenger door. I had 2 witnesses and the fact that they had a stop sign and I did not led the officer to find the other party at fault.
