Overview On 5 April 2023, Bruce Lehrmann, the well renowned liberal staffer fired the first shot in legal proceedings once again. This time, at the Australian Broadcasting Corporation (ABC), over its publication of a speech given by Brittany Higgins and Grace Tame to the National Press Club on 9 February 2022. The Daily Mail has been successful in appealing an earlier decision of Justice Bromwich, in the Federal Court case of Dailymail.com Australia Pty Ltd v Erin Molan [2023] FCAFC 26. The appeal follows the earlier judgment in Molan v Dailymail.com Australia Pty Ltd [2022] FCA 1004, where the famed television Erin Molan was initially successful in a claim for defamation against the Daily Mail for calling her, amongst other things, a racist. Changes to the Defamation Law in Queensland

From 1 July 2021, the Defamation Act 2005 (Qld) (Act) has been amended to incorporate a number of important changes to the process of pursuing defamation claims including by: introducing a serious harm threshold; making it mandatory to send concern notices; clarifying damages for non-economic losses; and providing additional defences to defamation.
