Hi, I am working for Company A, the division that I am working for, is spinning off into a new company B with a VC investment. My PERM is pending with USCIS and will take another 7-8 months, whereas the spin off will be done in next 2 months. I asked the company lawyers, but they are not giving any answer. I am on 7th year of H1B, so no more extensions for me unless PERM is approved. What happens to my PERM application pending with USCIS after spin off? Will it have to be restarted after spin off? Or we can wait for approval and add amendment? Please suggest and help! It has been a very stress ..read more

Let’s say USCIS has rejected a h1b petition ( i129 ) due to incomplete form or some other administrative error then can we follow up and resubmit that after June ?

What happens if USCIS has missed the petition , even though it’s highly improbable. But What happens ? What’s next ?
Let’s say we have Fedex receipt as proof of delivery to USCIS then in that case are we allowed to submit the petition after June 30 ?

today morning I see the h1b visa stamping wait times are very short like 16 days or 27 days. Last year jan…I saw its booked for like months. Am I totally missing something here ? or its just time of the year ?
and also I see wait days for Hyderabad and Chennai but not for new Delphi and Kolkata.

My I-797 petition and stamped H1B visa both have expired now. But I couldn’t enter United States even a single time before it expired. Can I approach another employer to transfer the same petition and assist me with re-stamping of visa without going through the fresh lottery process?

My current H1B expires in September. I am trying to change to a different team internally with a different job title (same location,salary). I’m still in interview process. Immigration lawyers have already started h1b extension under my current job title.
Am i eligible to apply extension and then change job title? Do the rules allow me to do this?

I appreciate your help.
I have i140 approved and have h1b petition and h1b visa stamped on my passport from company A.
I spent 6 years on H1B with Company A.
I am in India now.
Below are my questions.
If I leave Company A without transferring existing H1B, Can Company A withdraw my H1B petition?
if Company A withdraw my H1B petition, and if I join Company B. Can I file H1B on withdrawn H1B petition on cap exempt?
I am still in Company A, what are my best options?

I am in my 6th year of H1B visa. My original second H1B visa stamp expires Nov 2024, but my company used the time I spent in India when I joined them and got an h1b i797 approved till July 2025 during H1B transfer. After I joined them I got a self-sponsored I140 with NIW EB2.
Since my H1B visa stamp expires Nov 2024. I want to apply for Visa extension.
As I fill the DS160 form, I noticed that it only ask for H1B approval with my company, other that the “Is a immigration petition filled for you” place, there isn’t any location to enter my I140 information. Am I missing something? I have seen p ..read more

I’m currently on H1B and my status is going to expire on Oct 10th 2024. I work from home and I recently moved to a new place which is outside the MSA of the old place(my previous work location which is registered with USCIS). My employer is in the process of filing an H1B extension for me and the employer also got the LCA certified for the new work location.
My question is can my employer give the new work location in the H1B extension application or do they have to file another petition just for the location amendment?
