When Should a Lawyer Report a Mistake to a Legal Malpractice Insurer?

If you make a mistake while practicing law that results in harm to a client’s case, it is important that you promptly report the incident to your carrier.  Professional liability policies usually require that claims and potential claims be reported “as soon as practicable.”  Potential claims include “any circumstances that may reasonably be expected to give rise to a claim being made against an insured.”  The notice is required to be written.  A phone call to your insurance agent will not suffice. The Board of Governors of the State Bar of Georgia (BOG) voted overwhelmingly on Saturday to allow Georgia lawyers to practice without malpractice insurance. Although most lawyers are insured (approximately 70-75% of them according an estimate of the Professional Liability Insurance Committee), that still leaves as many as 10,000 uninsured lawyers practicing in Georgia. Dr. James Warner, pictured second from left, with his family.   Dr. Warner is a husband, father of three, and former high school band director. He holds a Ph.D. in Music Education and was a professional trumpet player. Following a left hip injury, Dr. Warner went to the hospital for a hip surgery.  He was placed under anesthesia.
