In December 2021, Maddens Lawyers launched a class action in the New South Wales Supreme Court on behalf of those impacted by the 4 December 2019 fire. The defendants to the claim are the property owners, Joseph, Moussa and Charbel Tannous & Kwik Flo Pty Ltd. Maddens Lawyers is advancing claims for compensation on behalf of travellers who booked a tour with Top Deck Tours Pty Ltd and have been unable to obtain a refund of the full amount they have paid. Due to COVID-19, Top Deck Tours has suspended all tours up until 31 August 2020. In April 2020 Top Deck Tours announced retrospective changes to its booking terms and conditions and cancellation policy.  Under the retrospective changes it is likely that many travellers will be worse off when compared to the terms and conditions that were in place at the time of their booking. The Terang/Cobden bushfire commenced on St Patrick’s Day, 17 March 2018. The fire destroyed in excess of 20 residential properties and caused extensive damage to many farming properties.
