The New Landlord Law Audit Kit – make sure you are compliant!
March 27, 2024
If you are a landlord or manage rented property, there is a lot you need to do and a lot of rules and regulations you need to comply with.
It is all to easy, in the heat of the moment, to forget to do something.
However, that something may have serious consequences. The authorities are becoming more pro-active and some of the fines for non-compliance can be very high.
Or your slip of memory could make it difficult for you to use section 21 or entitle your tenants to apply for a rent repayment orde ..read more

Right to rent problems – how your tenancy agreement can protect your position
February 19, 2024
With the massive increase in penalty fines for ‘right to rent’ breaches (discussed here) landlords need to do what they can to protect their position.
Your tenancy agreement can help here.
Limiting occupiers
Although you cannot prohibit tenants from having guests stay (within reasonable limits), you can make it clear in your tenancy agreement that:
Only the named persons in the tenancy agreement can occupy the property as their home – then make sure to check with tenants who will be living at th ..read more

New rules for emails from Landlord Law
January 8, 2024
They say that most of the emails flying around the world are spam. Which is a problem.
A problem for us all having to put up with it, and a problem for the various organisations that manage the system, who want to eliminate it.
To help the email companies deal with the spam problem, new rules are coming in, which will also impact those of us who are sending out ‘proper’ emails.
Dealing with the new email deliverability rules
One way that systems identify a sender as a spammer is if their emails are not opened or clicked (or if t ..read more

Checking over the right to rent checks article
December 5, 2023
Its some time since I looked at our main Right to Rent article. So, in view of the fact that the fines are due to increase dramatically in the new year, I thought I should check it over.
So I have gone in and done some amends. However, I think the most important message I have about right to rent is that Landlords should ALWAYS refer to the government’s online content!
If there is ever a difference between the government’s guidance and mine (or indeed anyone else’s) – please follow the government’s guidance!

Material Information to provide when renting out property
December 1, 2023
Landlords and letting agents should take note that new ‘material information’ guidance has been issued by National Trading Standards UK on the information to be provided in property adverts.
This is the culmination of work which has been ongoing for some time in collaboration with various industry bodies and the property portals.
It was deemed necessary as practices varied across the country and it is important to have consistency and clarity on what actually is ‘material information’ to be included in property adver ..read more

The Landlord Law Podcast – relaunched
October 27, 2023
Some of you may remember that I used to have a Landlord Law blog podcast with a blue image with a spinning house in it.
That podcast was initially hosted on a service called Lybsyn (which was a bit of a nightmare to deal with) and then on my former Landlord Law blog hosting company, Rainmaker.
When we moved the Landlord Law blog to a new host, the podcast sort of got left behind, and none of the old episodes are available any more.
So, I have archived it on Apple and relaunched a new Landlord Law podcast with a new image.

The Landlord Law Which Possession Proceedings Guide has been updated to include Welsh law
October 7, 2023
I’m on a bit of a roll updating our guides to include guidance for Welsh landlords.
The last of our ‘free guides’ to be updated is the ever popular Which Possession Proceedings Guide.
Why the guide is necessary
When bringing a claim for possession it is really important to have identified the correct procedure and to have served the correct notices first.
When you hear that a landlord has experienced awful problems getting their possession order and has had to spend huge sums of l ..read more
