Yesterday (January 31, 2024), the U.S. Citizenship and Immigration Services (USCIS) published a final rule related to filing fees under the EB-5 immigrant investor program. These represent a large increase in filing fees for prospects looking to move forward with their EB-5 investment.  Specifically, the following fees impact prospective investor’s costs of their EB-5 investment: I-526/I-526E filing fees will increase to $11,160. The I-526E is a new petition introduced by the EB-5 Reform and Integrity Act of 2022 (RIA), it replaces the legacy I-526 petition.  The I-526E is a significant step in the EB-5 immigration process and qualifies an investor for conditional permanent residency in the United States. This week, we learned that CMB Infrastructure Investment Group 82 received an I-956F approval! This is the second CMB EB-5 partnership to be approved since the new EB-5 regulations were implemented under the EB-5 Reform and Integrity Act of 2022 (RIA). The first, CMB Group 78, was approved last month. The hotel is located in the Harwood District of Dallas, TX and officially began accepting reservations on June 15th, 2023. In an exciting announcement published earlier this afternoon, the USCIS stated that Permanent Resident Cards (Green Cards) held by immigrant investors who have filed their I-829 petition for permanent residency will be valid for 48 months beyond the card’s expiration date. They state in the notice: We will issue new receipt notices to eligible conditional permanent residents who previously received notices with an extension shorter than 48 months and whose cases are still pending. - On Jan. 4, the Department of Homeland Security published notice in the Federal Register of their intention to increase fees for participants in the EB-5 visa program. The proposed fee hikes will impact Immigrant Investors using the EB-5 visa program to achieve permanent residence through the program. The EB-5 visa program requires participants to file two separate petitions. The initial petition, required to achieve conditional permanent residency, is form I-526E.
