Hello Everyone I am going to declare myself bankrupt following advice from Stepchange.  I am trying yo get all the info they require to get breathing space before my actual bankruptcy. I am on UC and PIP living in housing association property.  I understand that this should be a straightforward bankruptcy and I just need the fee to pay.  My only asset is my car which I own outright valued at around £10000. One of my sons has come to the end of a CVL (creditors vol liq??) and 'seems' to be completely free of his Ltd Coys massive debt.(Sole director). Bar any future credit reference problems, it seems amazing that you can avoid a debt of this size. (Incls HMRC, paye, bounce back loans {no director guarantee!). If it was a bancruptcy/IVA this wouldn't be the case would it? My worry is that my Will currently says "1/3 to each son" I remember when my Dad died the solicitor made a bancruptcy check on me (as any creditors would then have knowledge of my inheritance and have first dibs) IS?? he complet ..read more

My creditors are my sisters who I took to court because the evidence I have is that they have been Trustees of Trusts and have been dishonest. Despite (amongst so many other things) it turning out that there is another Trust, the judge believed they are really honest people who would not deprive me of my inheritance, at the same time as acknowledging he was not able to get a copy of the other Trust or discover who the Trustees were. DRO and bank frozen help?

I started the process for a DRO last week. They advised me to open a new bank account as my overdraft with Halifax would be listed in the DRO so my current account could possibly be frozen or closed. I applied for a new bank account with First Direct on Friday 19th April, I didnt hear anything back until Tues 23rd, and have only got my new bank card today so have been unable to start the switching process until now. In the meantime, I signed the final application for the DRO on Monday 22nd, and although they say it can take 10 days for a decision, it was accepted by Weds 24th.  So basical ..read more

I have a very close friend who is considering bankruptcy as his only option.  He was renting privately but due to a breakup he couldn't keep the rent payments up so gave notice to the landlord.  He bought a cheap 20 year old static caravan through 2 separate loans which was fine until last month when he was made redundant.  I have asked him to get financial advice before making a decision about bankruptcy but he thinks it's his best and only option.  Would the bankruptcy take the caravan to pay part of the debts, he won't confirm how much he owes but I am guessing its aroun ..read more

Hello all, Back in 2009 I declared bankruptcy which was discharged 12 months later.  I am now in an inheritance dispute with siblings and I have prove that the trustee in Bankruptcy is not interested in the property which i was beneficiary too at time of B but I didnt declare it as it was still unsure who were the beneficiaries and still isnt. Hi, My partner is due to settle my IVA soon and the creditors meeting has been arranged for a few weeks time. I'm currently half way through a 60 month agreement. My IVA repayments come always come out of my Halifax account and I have provided the Debt Supervisor with copies of my Halfiax statements and payslips to the end of March 2024.  One of the creditors is Barclaycard. I also have a Barclays Bank Account which has around £500.00 in. I'm just wondering if Barclaycard will check my Barclays Bank Account and will want the £500.00 in addition to their share of the settlement figure ..read more

Hello, I am probably going to file for bankruptcy once my tenancy agreement is renewed in a couple of months. My issue is, I am self-employed and have what would probably be considered a "good" income, but as I'm self-employed it's not always regular, I can have a £6000 month followed by a £2000 month - how does this work with an IPA? I'm almost certainly going to have one so I just wonder how they set it or work it out... Thanks for any advice, trying to prepare myself and not have a full breakdown or similar ..read more

im in need of some advice regarding being issued with a statutory demand order from dcb legal the debt is £8k inc charges.at present nothing as been done but they have a court order that allows them to issue it by email as ive moved and they dont know where i live. my concerns are that im told they can declare me bankrupt and place a charging order on my home (proceeds from an inheritance) now if that is the case and they force me to sell the house is there a time limit for the house to sell? im reading something about 3 years but i may be wrong. or could they just leave it on the propert ..read more
