On February 25, 2020, Dr. Nancy Messonier, the CDC’s director of the National Center for Immunization and Respiratory Diseases, announced that the public needs to prepare for the Coronavirus to become a pandemic. “It is not so much a question of if this will happen in this country anymore but a question of when this will happen,” she told reporters. “We are asking the American public to prepare for the expectation that this might be bad.” The week before this announcement, I started my Monday in Louisville and flew to Minneapolis for a connection in Denver. During that time, I boarded airplane ..read more

Video Clips Will Sway A Juror’s Opinion in 30 Seconds (or less) As humans, jurors develop an opinion about a witness within the first 30 seconds of seeing them. Decades of research in social psychology illustrate the surprising power of first impressions. From contexts as diverse as evaluating classroom teachers, selecting job applicants, or predicting the outcomes of court cases, human judgments made on the basis of just a “thin slice” of observational data can be highly predictive of subsequent evaluations. The term thin slice comes from a frequently cited article by Ambady and Rosenthal (19 ..read more

A stenographer from New York recently posted an article on his personal blog titled “Verbit Published Kentuckiana Proceeding Audio Online Without Anyone’s Permission”. On the surface, the point of his article was to identify an alleged incident by Verbit regarding a deposition handled by Kentuckiana Reporters. However, the author of the blog then takes this single event and uses it to argue that all digital court reporters are unprofessional, that they are poorly trained, that they do not take privacy or confidentiality seriously and, that they should not be an accepted method of creating a de ..read more

1. Bring a Photo ID. The court reporter will have to ensure that the witness has been properly identified and will ask for a non-expired ID. Preferably, use a driver’s license, passport or state issued ID card. If you need to use a different form of ID, please ask in advance. 2. No Kids. No Pets. The most common distractions are kids and pets. If you had to give testimony at trial, you would not bring your dog and cat to the courtroom. Find a sitter for all pets and kids during your online deposition. 3.  No Distracting Backgrounds. Make sure the room you choose for the witness has nothin ..read more

It was with both amusement and concern that I recently read an article from Christine Phipps instructing lawyers to only hire stenographic court reporters. Phipps’ article was apparently emailed directly to many attorneys, including our clients. It was amusing because it sounded like a horse-and-buggy driver warning about the dangers of automobiles. That is, it was low on facts and high on fearmongering. The article concerns me because it is a rejection of technology and a call for our legal system to embrace higher and unnecessary costs when it is already under heavy financial stress.
