Electric bicycles seem like a hassle-free way of riding off road without the issues associated with finding legal trails to explore on a motorcycle. But where exactly can you ride an e-bike, and what happens if you want to give yours a little power boost? I am the proud owner of a fancy new electric ..read more

If you have been unlucky enough to have been knocked off this article is of immense importance to you. I won’t mince my words; you become a traded commodity for insurers/claims management companies and law firms. That is sad but true. I will look at one narrow area of the system, consider your own rights and hopefully it will steer you through the early process should the unthinkable happen. Let me start at the very beginning. Us bikers love our bikes; so, the first thing we usually do after an accident is usually check the state of our beloved motorcycle. I kid you not, I have watched a GoPro ..read more

The driver says I’m to blame. Can he do that?

I was riding along the main road when a car emerged from a side road and into my path. Luckily, I sustained fairly minor injuries but the case has turned into a nightmare on two grounds. The first is that I didn’t use my fully comprehensive insurance and used what I was told were ‘credit repairs’ – ie, my bike would be repaired by an accident management company, not by my insurer. The credit repair bill with storage and engineers’ charges looks extortionate to me, and the other guy’s insurers are making a fight of that. The second issue is that the other driver has formally said in his defence ..read more

Defective Bike – Dealership

Nothing quite takes the shine off a new bike purchase than a fault appearing. I am sure we have all been there and some dealers are better than others at putting things right, but where do you stand legally? The law is simple enough, you are protected by the Consumer Rights Act 2015. This piece of legislation applies to lots of consumer transactions, and that is the starting point, you must be a consumer to benefit. Business to business contracts is excluded. So, if you have just purchased a shiny new [insert the bike of your choice here] and a fault appears you have the absolute right to reje ..read more

What happens if you get kicked off a bike by a horse? Well, since you asked… I was riding along a country lane and almost got hit by a horse. Yes – not the other way round! The rider tried to blame me and my noisy motorcycle, but I cut the engine and coasted by them both. The horse kicked out and luckily, I managed to ride by before it could turn and clobber me off my bike. This got me talking down the pub with some friends… if there had been an accident, who would be to blame? Answer Ahh, the joys of wildlife and motorcycles. The law on this topic is pretty old. From a criminal perspective, i ..read more

Motorcycle Insurance, the law and modifications

Ahh the age-old question about insurance and your motorcycle. What do you need to declare? Is it enough? Have you missed anything off, what should have been included? Is the bike under-insured? Can they void my policy? Your contract of insurance, the clue is in the name, is contractual in nature. That is the basis upon which it exists, and that contract will tell you what you and your insurer must both do. However, Parliament has had something to say about such contracts and a decade ago The Consumer Insurance (Disclosure and Representations) Act was given Royal Assent and became law. This is ..read more

Criminal and civil courts, and you…

You would think a criminal conviction against a biker would automatically debar any successful civil claim. Oddly the answer is no, it would not. To delve further into this curious topic and work out why, we need to look into our legal system. We operate distinctly different courts in England and Wales. The magistrates’ court is the first criminal court you will ever deal with, with more serious matters going up to the Crown Court. All criminal matters must start in the magistrates’ court. Even a murder trial starts here, although it is just a gateway hearing to pass it up to the Crown Court ..read more
