So those who don't know, or don't remember, my ex and I were in a year long battle that ended at a Settlement Conference. From 2012 to 2019, my ex had EOW with our 10yo Son. Ex started court proceedings asking for 50/50 custody, majority parenting-time and no child support despite making $170,000 in the year. I had been unrepresented the entire time while my ex had a lawyer. Hello- I need advice/direction for my actions: Issue- FSO ask me for Support arrears collection in 10 days or will go to collection bureau etc. (1) I filed for divorce when I was living in Quebec (before lived in Ontario). case transferred to Ontario. (2) A new case file by wife in Ottawa without any notice to me and in my absentia Judgment order was sent for a Support money to me. Cost Penalties proportional to ability to pay / income

Hi all, Curious if there's any precedence for Cost Penalties (or even Cost Submission results) being proportional to a parties income / ability to pay. I haven't been able to find anything. I ask as I'm running into a scenario where Costs (including penalties) are being awarded, but they are inconsequential compared to the payers actual income. As the penalties are so low, the penalized party continues to be in breach of said awards as the cost penalties are costing them peanuts. Thanks ..read more

I haven’t been around much in a few years, as my situation has been resolved and stable, at least as much as one can hope for. Unlike many here, we didn’t go to court, as we both behaved reasonably and we have been coparenting our joint custody in relative success. He’s manipulative, I’m easy-going. He’s one of those ‘easier to ask for forgiveness than permission’ people. This has manifested in him deviating from the set schedule with little notice to suit his plans (mostly giving up his access time or taking an extra day), and expecting me to just go along with it. Insight encouraged... In Ontario, I cannot see any direction under procedures that a form 14A (Affidavit - general) be included with a Motion to Change (form 15). Only under Service, did I see reference to it: Motion to Change (Form 15), along with an affidavit (Form 14A). https://www.ontario.ca/document/guid...your-documents I suspect that it's prudent to include a form 14A (with Exhibits) to support any claims being made. Lowering ss if ex recohabitates

hi from my understanding when an ex remarries/repartners the non compensatory side of SS will decrease. Right now we are still interim x 4 years as they are dragging heels Ex BF has essentially moved in and I likely will have to go a PI route. The kids basically told me, but the ex loves to lie. The BF i believe still has his own place and may be selling to roommate or renting his part of house out. My question, what are the factors to meet a threshold to make this relevant to lower SS in any way? For example, if it was someone on wellfare it will not matter. I searched the forum and couldn't find a relevant thread. Brief background...somewhat high conflict ex, no court order, just an agreement we mediated through our lawyers. I'm paying both SS and CS (ex also pays me CS as it was originally 50/50). End of CS is determined using the usual terminating events.
