Can ‘The Indian Independence Act 1947’ be repealed by the British Parliament today? India got independence through an Act of British Parliament. What if that Act is repealed today?  It is a well-recognized principle that a parliament or legislative assembly which has power to make a law, also has the power to repeal it. Lost Head. Let’s see who can actually shift or make a bench of the High Court. The Constitution of India in Article 214 provides “ There shall be a High Court for each State”. It does not provide for any place of sitting of the High Courts. The Uttar Pradesh Reorganization Act, 2000 under Section 26 provides the principal seat of High Court to be notified by a Presidential Order. Do we really have the option of appearing in the court of law, wearing only plain white shirt/ salwar-kameez or saree with band because of threat of COVID-19? Let us start with our own statute. Section 49 (gg) of the Advocates Act gives power to the Bar Council of India to make rules with regard to the dresses or robes  to be worn by advocates, having regard to the climatic conditions, appearing before any court or tribunal. Declaration of Martial Law with enactment of Indemnity Act is a gold mine of absolutism available to the government under Article 34 of the constitution of India.
