My listing for a promo record was taken down, reason: counterfeit

I listed a promo album for sale (Elvis Costello Live at the El Mocambo) that has been removed by ebay. The auto-email said it violated their counterfeit item policy. It is a promo, but it is not counterfeit. In their eyes, does "promo" = counterfeit? Also, a search reveals several others, both LPs and CDs, of this same item actively for sale. I thought fees were 10-15 percent per transaction. This is almost half for a 1 dollar sale. I would be losing money each time I sold something. Am I doing something wrong? We increased our promotional rate from 2% to 4%, and these are the results. More impressions, sure, but our click through rate is the same, and our sales conversion rate has actually gone down. Listing impressions and listing page views are not sales, unless we’re missing something? As I mentioned in a previous post here, I am a new seller (I’m in Canada). However, I am currently struggling with selling some of my items. All my listings are local pickup only (only buyers in Toronto and the GTA can pick up) and no shipping to anywhere else in Canada, to avoid buyers having to pay extra money. I’m in my first < 6 months of selling on eBay (consistently as a part-time job). I’m getting closer to having 400 items and getting close to the free 250 items listed free a month (for when I relist older items that counts towards it too and I’ve noticed that has helped increase my sales of older items). At what point should I be switching over to an eBay store and what level is best for a beginner? If i have a business account, Do i need to pay the 0.36 listing fee every month my item does not sell? What if I have 50 of the same item. Will i have to pay 0.36 every month or (50 x 0.36) for each of my individual items?
