I got my information on retainer, do's and dont's and my P&L forms. Retainer plus court fees are about $2500 which I don't have so while I get that money ready, do I just ignore the calls from my creditors requesting me to make a payment? My main concern is wtf happens if I get rejected? I really don't want to come out of this absolutely ruined. I'll need maybe another 3 weeks to get that cash together. I do however intend to keep making my car payments as I need to keep it for work. My primary bank account is also tied to one of the credit card companies I'll be ghosting. Whats the risk ..read more

I am having a heck of a time securing a car loan after filing Chapter 13 July 2023. I knew things would be hard but I feel like I am doing something wrong. First, everyone talks about the relief that comes from filing bankruptcy. I am feeling very little relief. I am paying nearly 1300$ a month and it is a challenge. I have a list the length of my arm if house repairs and kid-related costs that I keep having to put off because this gigantic bill each month. Second, I am trying to get out of a high cost vehicle to lighten the load and I keep reading post after post after post of people having ..read more

Question about state tax offset in Ch 13

Hello! Just looking for information from anyone who has been in a similar position. My plan was confirmed 3/9/24. I filed my taxes 4/12/24. Nothing back for federal and state is showing a refund due to me to be deposited by 4/29 per the site. My trustee sent a letter stating that I have to turn over $0 of my tax refund due to me being in 100% repayment. However, I owe some back state taxes and was wondering if they will/can offset my state taxes while I’m in active bankruptcy or if I can expect to receive my refund. submitted by /u/Sweaty-Assumption-95 [visit reddit] [comments ..read more

Hi! I know I should talk to a BK to get the most accurate information specific to my situation. However, I thought I would ask here to see if anyone has a rough idea. Basically I’ve made terrible choices in my life and now have overwhelming amounts of debt. Im an active duty service member stationed in one state but own a house in another. It recently just got tenants as well. I am not making big money on it, in fact I’m losing money currently. What happens to that house if I try to file? Can I keep it? Do I inadvertently fuck the tenants and force them to move? submitted by /u/Any-Negotiati ..read more

Chapter 13 plan, can someone explain why the length of time remaining is 20 months but my payments are expected to be 1000 dollars for 36 months when I have to repay the 19,000 dollars. I am so confused and speaking to my attorney did not help clarify. 36x1000 is equal to 36,000 copy of my breakdown schedule submitted by /u/SwordfishLongjumping [visit reddit] [comments ..read more

My spouse is AD military. BAH is counted as income from what I’ve been reading. We live in a high COL area and get $4300 a month but we live in military housing and they get all $4300. Will this make a difference for the means test? I work FT but am currently on medical leave for an injury at work, my pay will be through workers comp. Will that make any difference? I’m ready to file like yesterday but have to wait until after the summer. I really want to just stop paying my credit cards right now, would that be a bad move? We don’t own a home, 3 cars, hoping to keep 2 of them. Located in CA ..read more
