In November 2016, Floridians overwhelmingly voted in favor of Amendment 2, with over 70 percent votes in favor of that measure which required 60 percent approval for it to pass. Amendment 2 is a bill that expands the use of medical marijuana in Florida for patients with certain diseases and conditions. However, just because medical marijuana has been allowed in Florida it does not mean that penalties for the illegal use, possession or distribution of recreational marijuana have become any less severe. However, this simply isn’t the truth in the state of Florida when it comes to the justice system. This is overly apparent when viewing the sentencing disparities amongst defendants who are black and white. The evidence conclusively shows that people of color face discrimination within the courtroom, be it explicit or implicit, when it comes to sentencing. These numbers don’t lie — black defendants have been receiving longer sentences ..read more

5 Things TV Shows Get Wrong About Criminal Law Criminal justice shows such as “Law & Order”, “How to get Away with Murder”, and “Suits” are exciting, nerve wrecking, inspirational, and incredibly popular. However, TV shows hide, manipulate, and even flat out ignore aspects of criminal law because in the end all that really matters are the ratings. Adam Stout, a Gainesville criminal lawyer at Stout Defense, P.A., points out some of the misconceptions between criminal law shows ..read more

Social Media's Growing Role in Law Enforcement Social media has provided a tight network for people and communities to stay in touch at all times, and its wide outreach has become appealing to more than just regular users. The instant transmission of information has prompted law enforcement to adopt the platforms. But as social media’s role in law enforcement grows, so does controversy regarding the rights of those who are arrested and publicized on the web. Consider this; there are nearly 400 inmates currently on death row in the state of Florida. Statistics such as this show that Florida is one of the country’s leading practitioners of the death penalty. In addition to Florida, 30 other states across the union impose the death penalty. Nevertheless, there is a heated debate within Florida, and across many other states, about the constitutionality of state-sponsored executions. In January of this year, the U.S. Supreme Court struck down Florida’s existing death penalty law — Hurst v. Florida, 136 S. Ct. 616 (2016). This decision was based on ..read more

As we approach November 11th, in anticipation of Veteran’s Day, we as a country pay homage to those that have served, and especially to those that have sacrificed their lives so that we may be free from harm and oppression. Later, this day would be renamed Veteran’s Day in 1954. For me, Veteran’s Day is also a time for reflection ..read more
